Terms of Service

These Terms of Service ("Terms") govern your use of the LotTrack Pro mobile application ("App") operated by Evolution Software LLC ("we", "us", or "our"). By using the App, you agree to these Terms.

1. Account Registration

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

2. Subscription and Billing

• The App offers a free tier with limited features and a Pro subscription with full access.
• Pro subscriptions are billed through Google Play (Android) or the App Store (iOS).
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• Refunds are handled according to the policies of Google Play or the App Store.
• Lifetime purchases grant perpetual access to Pro features with no recurring charges.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or to violate any laws.
• Attempt to gain unauthorized access to other users' data or accounts.
• Upload malicious content, viruses, or harmful code.
• Reverse engineer, decompile, or disassemble the App.
• Use the App to store or transmit content that infringes on intellectual property rights.

4. Your Data

You retain ownership of all data you enter into the App (vehicle records, photos, financial data, etc.). We do not claim any ownership rights over your content. You grant us a limited license to store and process your data solely to provide the App's services.

5. Team and Multi-User Access

If you invite team members to your business account, you are responsible for managing their access and permissions. You may remove team members at any time through the App's settings.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service unavailability.

7. Limitation of Liability

The App is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Evolution Software LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your data will be deleted within 30 days unless retention is required by law.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the App or email.

10. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law provisions.
